This Indenture made the Twenty fourth day of of September in the Twenty third year of the Reign of our Sovereign Lord George the Third by the grace of God of Great Britain France and Ireland King Defender of the faith &c and in the year of our Lord One thousand seven hundred and Eighty Three Between William White late of Ramsgate in the Isle of Thanet in the County of Kent but now of Gosport in the County of Hants Mariner one of the three Sons and Coheirs in Gavelkind of Sarah White late of Ramsgate aforesaid Widow Deceased (sometime Sarah Spencer Spinster) who was a Daughter of and Devisee named in the last Will and Testament of William Spencer late of Ramsgate aforesaid Mariner Deceased (which Sarah White died Intestate) of the one part and William Lilleford the younger of Ramsgate aforesaid Mariner and George Kenard of the same place Mariner of the other part Witnesseth that for and in Consideration of the Sum of Forty Four pounds thirteen Shillings and Four pence of Lawful money of Great Britain to the said William White in hand well and truly paid by the said William Lilleford and of the like sum of Forty Four pounds thirteen Shillings and Four pence of like lawful money to the said William White in hand well and truly paid by the said George Kenard at or before the Sealing and delivery of these presents the receipt of which the two several Sums of Forty Four pounds thirteen Shillings and Four pence and Forty Four pounds thirteen Shillings and Four pence the said William White both hereby acknowledged and thereof and of every part thereof doth acquit release and discharge the said William Lilleford and George Kenard and each of them their and each of their Heirs Executors administrators and assigns and every of them for ever by these presents He the said William White hath Granted Bargained Sold Aliened Released and Confirmed and by by these presents Doth Grant Bargain Sell Alien Release and Confirm unto the said William Lilleford and George Kenard (in their actual possession now being by Virtue of a Bargain and Sale to them thereof made by the said William White in Consideration of Five shillings to him paid by the said William Lilleford and George Kenard by Indenture bearing date the day next before the day of the date of these presents for the term of one Whole year commencing from the day next before the day of the date of the same Indenture and by force of the Statute for transferring uses into possession) and to their Heirs and Assigns All that One full Equal undivided third part (the whole in three Equal parts to be divided) and all other the part purpart and Share whatsoever of him the said William White of and in All that Messuage or Tenement (late heretofore built and Erected) with the Outhouses Edifices Buildings yards Backsides and Ground thereunto belonging and adjoining and therewith usually held used and Enjoyed Situate lying and being in Ramsgate aforesaid in the said Isle of Thanet and County of Kent in or near a certain Street there called the Brick Street heretofore in the Tenure or Occupation of Thomas Parkinson or his assigns and now or late in the Tenure or Occupation of Hannah Witherden Widow or her assigns Together with the free and Common use and benefit at all times (with the Tenants or Occupiers of Certain other Messuages near thereunto) of a certain Grass Plat or Bleaching Spot Situate in or near the said Street and adjoining to a certain Messuage and premises there now in the Occupation of Mary Gregory Widow and to a certain Messuage and premises there of John Holman and free Way and Passage to and from the said Grass Plat or Bleaching Spot by and through a certain Gate next the said Street and at the West End of the said Messuage and premises in occupation of the said Mary Gregory And of and in all Ways Paths Passages Waters Water Wells Water Courses Walls Fences Inclosures Lights Easements Liberties Privileges Profits advantages Emoluments Hereditaments and appurtenances whatsoever to the said Messuage or Tenement first above mentioned belonging or in any wise appertaining or therewith or with any part thereof usually held used and Enjoyed or accepted reputed taken or known as part parcel or member thereof or of any part thereof And the Reversion and Reversions Remainder and Remainders Rents Issues and profits thereof And also all the Estate Right Title Interest Use Trust Inheritance Claim property and demand whatsoever both at Law and in Equity of him the said William White of in to or out of the said one full Equal undivided third part of and in the said first above mentioned Messuage or Tenement Hereditaments and premises or of in to or out of any part thereof To have and to hold the said One full Equal undivided third part (the whole in three Equal parts to be divided as aforesaid) and all other the said parts purparts and Shares of and in the said Messuage or Tenement Hereditaments and premises herein first above mentioned and hereby or mentioned or intended to be hereby granted and released with the appurtenances unto the said William Lilleford and George Kenard their heirs and assigns To and for the several uses following (that is to say) As for and concerning one Equal undivided Moiety or half part of and in the said third part with the appurtenances To the only proper use and behoof of the said William Lilleford his heirs and assigns for ever And as for and concerning the other equal undivided Moiety or half part of and in the said third part with the appurtenances To the only proper use and behoof of the said George Kenard his heirs and assigns for ever And the said William White for himself and his executors and administrators doth hereby covenant promise and grant to and with the said William Lilleford and George Kenard their heirs and assigns in manner following, that is to say, That (for and not withstanding any act matter or thing whatsoever by him the said William White or any of his ancestors or by any person or persons claiming or to claim by from under or in trust for him them or any of them done committed or wittingly or willingly suffered to the contrary) he the said William White now at and immediately before the Execution of these presents is lawfully rightfully and absolutely Seized in his Demesne as of Fee of the said full equal undivided third part of and in the said herein first above mentioned Messuage or Tenement Hereditaments and all other the premises hereby or mentioned or intended to be hereby granted and released with the appurtenances of and in a good sure lawful perfect absolute and indefeazible Estate of inheritance in Fee Simple to the only use of himself and his heirs without any condition limitation power of revocation Trust Reversion Remainder or any other restraint matter or thing whatsoever to alter change charge revoke defeat determine or incumber the same Estate or the use thereof And that (for and notwithstanding any such act deed matter or thing as aforesaid) he the said William White now hath in himself good right full power true title and lawful and absolute authority to grant bargain Sell alien Release and Convey the same full Equal undivided third part of and in the same Messuage or Tenement Hereditaments and all other the premises aforesaid with the appurtenances unto and to the use of the said William Lilleford and George Kenard their Heirs and assigns in manner and Form aforesaid and according to the true intent and meaning of these presents And Further that it shall and may be lawful to and for the said William Lilleford and George Kenard their heirs and assigns from time to time and at all times hereafter peaceably and quietly to to Enter into and upon have hold use occupy possess and Enjoy the said one full undivided third part and all other the premises hereby or mentioned or intended to be hereby granted and released with their appurtenances and to receive and take the Rents and profits thereof and of any part thereof to and for their own use and benefit according to the Limitations aforesaid without any lawful let Suit hindrance molestation Eviction Claim or demand whatsoever of or by the said William White his heirs or assigns or of or by any other person or persons claiming or to claim by from under or in trust from him them or any of them or by under or in trust for any of his ancestors And that free and clear and freely clearly and absolutely acquitted exonerated and discharged or otherwise by him the said William White his heirs Executors or Administrators well and sufficiently saved defended kept harmless and indemnified of from and against all and all manner of former and other Gifts Grants Bargains Sales Leases Mortgages Jointures Dowers Rights and Titles of Dower uses Trusts Wills Intails Legacies Settlements Statutes Recognizances Judgements Extents Executions Annuities Rents and Arrears of Rent and of from and against all other Estate Rights Titles Troubles Debts Charges Incumbrances Claims and Demands whatsoever had made done committed occasioned or suffered by the said William White or any of his ancestors or to be had made done committed occasioned or suffered by the said William White his heirs or assigns or by any other person or persons claiming or to claim by from under or in trust for him them or any of them or any of his ancestors or by through or with his their or any of their assent consent act means privity or procurement (the accustomed Rents and Services from henceforth to become due for the said premises to the chief Lord or Lords of the Fee thereof only excepted) And Moreover that he the said William White and Jane his now Wife and his heirs and all and every other person and persons having or lawfully claiming or who shall or may so have or claim any Estate Right Title Trust or Interest at Law or in Equity of in to or out of the said one full Equal undivided third part of and in the said first mentioned Messuage or Tenement Hereditaments and premises hereby or mentioned or intended to be hereby granted and released or of in to or out of any part thereof from for by under or in trust for him them or any of them of from for by under or in trust for any of his ancestors shall and will from time to time and at all times hereafter upon every reasonable request and at the proper costs and charges in the Law of the said William Lilleford and George Kenard their heirs or assigns make do acknowledge levy Suffer and Execute or cause or procure to be made done acknowledged levied Suffered and Executed all and every such further and other lawful and reasonable act and acts deeds devices conveyances and assurances in the Law whatsoever for the farther better more perfect and absolute granting conveying and assuring the same third part and premises unto and the use of the said William Lilleford and George Kennard their heirs and assigns in manner and Form aforesaid Be it by Fine Feoffment Common Recovery or otherwise as by the said William Lilleford and George Kennard their heirs or assigns or by their either or any of their Counsel learned in the Law shall be reasonably devised or advised and required In Witness whereof the said parties to these presents (written on parchment legally stamped) their Hands and Seals interchangeably have set Dated the day and year first above written.
