This indenture made the nineteenth day of October in the year of our Lord one thousand eight hundred and thirty seven between Mary Townley of Ramsgate in the Isle of Thanet in the county of Kent widow of the one part and Thomas Hodges Grove Snowden of Ramsgate aforesaid Gentleman of the other part Whereas the said Mary Townley being seized of or otherwise well entitled to the piece or parcel of land and hereditaments hereinafter particularly described and intended to be hereby granted and released with the appurtenances for an estate of inheritance in fee simple in possession hath contracted with the said Thomas Hodges Grove Snowden for the absolute sale to him of the same piece or parcel of land and hereditaments and the inheritance thereof in fee simple together with such rights of way privilege and advantages as are hereinafter mentioned free from incumbrances at or for the price or sum of two hundred and eighty pounds Now this indeture witnesseth that in pursuance of the said recited contract and in consideration of the the sum of Two hundred and eighty pounds of lawful British money to the said Mary Townley paid by the said Thomas Hodges Grove Snowden at or before the sealing and delivery of these presents the receipt whereof the said Mary Townley doth hereby acknowledge and of and from the same doth hereby acquit release and for ever discharge the said Thomas Hodges Grove Snowden his heirs executors administrators and assigns She the said Mary Townley Doth by these presents grant bargain sell release and confirm with the said Thomas Hodges Grove Snowden (in his actual possession now being by virtue of a bargain and sale to him thereof made by the said Mary Townley in consideration of five shillings by indenture bearing date the day next before the day of the date of these presents for the term of one year commencing from the day next before the day of the date of the same Indenture or bargain and sale and by force of the statute made for transferring uses into possession) and to his heirs All that triangular piece or parcel of land situate lying and being in Ramsgate aforesaid in the said Isle of Thanet and county of Kent immediately at the rear of the Houses on the west side of the Royal Kent Terrace there and between the same and the paved footway heading from Harbour Place to Albion Place hereinafter mentioned containing by admeasurement in length from north to south in front or on the west side thereof one hundred and nine feet and two inches little more or less and in rear or on the east side thereof one hundred and two feet little more or less and in depth from west to east on the north side thereof twenty nine feet and eleven inches little more or less and varying in depth to the south point thereof according to the dimensions laid down in the plan hereinafter referred to abutting and adjoining to the said paved footway leading to Albion Place in front towards the west in part to land and a wall thereon of William Saxby and in other part to Land and a continuation of the same wall of Thomas Wellard King in rear towards the east to other lands of the said Mary Townley towards the north and to the said paved footway leading to Albion Place towards the south Together with the wall now standing on the said piece or parcel of land intended to be hereby released in front or on the west side thereof and dividing the same piece of land from the said paved footway leading to Albion Place aforesaid Together with full and free liberty license and Authority to and for the said Thomas Hodges Grove Snowden his heirs appointees and assigns and his and their tenants or lessees or other owners and occupiers for the time being of the said piece or parcel of land hereby granted and released or intended so to be or any part thereof or of the Messuages or tenements to be erected thereon and his and their respective families visitors and servants for ever hereafter on all occasions to pass and repass in through over and along the said paved footway of the width of ______ feet (in the said Plan coloured buff) in front or on the west side of the said piece of land hereby granted and released and leading from and to Harbour Place passing by the west side of Pier Castle to and from Albion Place in Ramsgate aforesaid Together with several other ways roads paths and passages communicating with the said piece or parcel of land hereby granted and released or intended so to be or in anywise appurtenant or belonging thereto which said piece or parcel of land and hereditaments hereby granted and released are more particularly described or delineated or by the Map or Plan drawn in the margin of these presents and therein coloured blue Together also with all and singular other rights members privileges commodities advantages emoluments liberties wells waters watercourses and appurtenances to the said piece or parcel of land and hereditaments hereby granted and released or intended so to be belonging or in any wise appurtenant And the reversion and reversions remainder and remainders rents issues and profits thereof And all the estate right title interest property claim and demand whatsoever at Law or in Equity of her the said Mary Townley of in to and out of the said piece or parcel of Land hereditaments and premises hereby granted and released or intended so to be and every part thereof To have and to hold the said piece or parcel of land hereditaments and all and singular other the premises hereby granted and release or intended so to be with their and every of their appurtenances unto the said Thomas Hodges Grove Snowden and his heirs for ever To such uses upon such trusts and in such manner and form as the said Thomas Hodges Grove Snowden shall by any deed or deeds direct limit or appoint and in default of such direction limitation or appointment To the only use and behoof of the said Thomas Hodges Grove Snowden his heirs and assigns for ever And the said Thomas Hodges Grove Snowden doth hereby declare that any women who shall become his widow shall not be intitled to dower out of the same hereditaments and premises or any of them or any part thereof And the said Mary Townley doth hereby for herself her heirs executors and administrators covenant promise and agree with and to the said Thomas Hodges Grove Snowden his heirs appointees and assigns in manner following (that is to say) that for and notwithstanding any act deed matter or thing whatsoever by her the said Mary Townley or by her late husband James Townley deceased or any person or persons lawfully claiming or to claim by from through under or in trust for her or him at any time or times heretofore made done committed or suffered to the contrary she the said Mary Townley now at the time of the sealing and delivery of these presents is lawfully rightfully and absolutely seized and possessed of or otherwise well intitled to

said piece or parcel of land and hereditaments hereby granted and released or intended so to be with their appurtenances for an absolute and indefeasible estate of inheritance in fee simple in possession and that for and notwithstanding any such act deed matter or thing as aforesaid she the said Mary Townley now at the time of the sealing and delivery of these presents hath in herself good right full power and lawful and absolute authority to grant release and assure the said piece or parcel of land rights of way hereditaments and premises hereby granted and released or intended so to be and every part thereof with their appurtenances unto the said Thomas Hodges Grove Snowden and his heirs to the uses and in manner aforesaid according to the true intent and meaning of these presents and that notwithstanding any such act deed matter or thing as aforesaid the said piece or parcel of land rights of way hereditaments and premises hereby granted and released or intended so to be shall from time to time and at all times hereafter remain continue and be to the uses herein before declared concerning the same and shall be peaceably and quietly had held used occupied possessed and enjoyed accordingly without any let suit trouble eviction ejection expulsion interruption hindrance or denial whatsoever of from or by the said Mary Townley or her heirs or any other person or persons claiming or to claim through under or in trust for her or them or through or under the said James Townley deceased And that free from or otherwise by the said Mary Townley her heirs executors or administrators well and sufficiently saved harmless and kept indemnified from and against all estates titles troubles charges and incumbrances whatsoever had made done committed or suffered by the said Mary Townley or by the said James Townley deceased or any person or persons claiming or to claim by from through under or trust for her or him And moreover that she the said Mary Townley and every person whosoever having or claiming any estate right title or interest at Law or in Equity in to or out of the said piece or parcel of land rights of way hereditaments and premises hereby granted and released or intended so to be or any part thereof by from through under or in trust for her or the said James Townley deceased shall and will at all times hereafter at the request cost and charges of the said Thomas Hodges Grove Snowden his heirs appointees or assigns make do and execute all such further and other acts deeds matters or things conveyances and assurances whatsoever for the better more perfectly or satisfactorily granting releasing conveying and assuring the same piece or parcel of land rights of way hereditaments and premises with their appurtenances to the uses aforesaid or otherwise as the said Thomas Hodges Grove Snowden his heirs appointees and assigns shall direct or appoint as by the said Thomas Hodges Grove Snowden his heirs appointees or assigns or his or their Counsel in the Law shall be reasonably advised or devised and required And further that she the said Mary Townley her heirs or assigns Tenants or Lessees shall not nor will at any time or times hereafter permit or suffer any noxious or offensive trade or business to be exercised or carried on upon the land or ground belonging to the said Mary Townley or on any part thereof lying between the cliff and the said piece or parcel of land and hereditaments hereby granted and released or intended so to be And also that she the said Mary Townley her heirs and assigns shall and will at all times hereafter (if not prevented by fire or other inevitable accident) at the request costs and charges of the said Thomas Hodges Grove Snowden his heirs appointees or assigns produce and show forth or cause to be produced and shown forth unto the said Thomas Hodges Grove Snowden his heirs appointees or assigns or unto such person or persons as he or they shall direct or require all or any of the deeds or writings mentioned or referred to in the schedule hereunder written and from time to time at the like request costs and charges (if not prevented as aforesaid) make and deliver unto the said Thomas Hodges Grove Snowden his heirs appointees or assigns true and attested copies of or abstracts or extracts of or from the same deeds and writings or any of them and permit such copies abstracts or extracts to be examined and compared with the originals by any person or persons whom the said Thomas Hodges Grove Snowden his heirs appointees or assigns shall appoint for the purpose And this Indenture Lastly Witnesseth that in pursuance of a previous stipulation and agreement in the behalf on the part of the said Thomas Hodges Grove Snowden upon the treaty for the purchase of the said piece or parcel of land hereby granted and released the said Thomas Hodges Grove Snowden doth hereby for himself his heirs appointees and assigns covenant promise and agree with and to the said Mary Townley her heirs and assigns that no part of any houses buildings or erections to be erected on the said piece or parcel of land hereby granted and released or intended so to be nor the chimneys of such houses shall exceed the height of the parapet wall built against the cliff behind the Royal Kent Terrace at the lowest part of such wall nearest to the top landing of the steps leading to Albion Place aforesaid and that he the said Thomas Hodges Grove Snowden his heirs appointees or assigns shall not nor will permit or suffer any noxious or offensive trades or businesses to be exercised or carried on on the said land or in any house or buildings to be erected thereon and that no outside work shall be done in the exterior of any Houses or other Buildings to be erected on any part of the said piece or parcel of land between the first day of July and the first day of November in every year In Witness whereof the said parties to these presents have hereunto set their hands and seals.

The use of a footway of the width of four feet in the within Plan coloured crimson at the rear of the south end of the piece of land by the within indenture of release and leading from and out of the within mentioned paved footway into and from a four feet way of Thomas Wellard King at the rear of the houses in the royal Kemt Terrace and intended to have been granted by the within deed. I therefore grant unto the within named Thomas Hodges Grove Snowden his heirs and assigns the use of the said footway to be enjoyed by him and them in such and the same manner as the other ways within granted.
